Bodycam footage played in court
POLICE bodycam footage shown to Mackay Magistrate's Court today showed a 38-year-old Blacks Beach man trying to roll onto the floor and sit on the police officer who arrested him.
The man, who cannot be named to prevent identification of his children, was charged with
Obstructing Police after the incident.
The court heard the man was arrested on two occasions on September 23 and 24, 2020 and faced charges of stealing a Samsung Galaxy S mobile phone from his two primary school aged children’s school bag on January 10.

sit on the arresting officer, Constable Morley, which would have put the officer at risk of being
The accused admitted to keeping the phone in retaliation for his ex-wife and her new husband
allegedly not returning sports shoes and other children's play equipment, and he told the
Magistrates Court that he had asked for an exchange of goods at a police station.
The Court heard of a difficult and emotionally charged eight-year shared custody arrangement of
week-on week-off care of the two primary school aged children.
The man has pleaded not guilty to both charges and denied the police prosecutor’s allegation of
smashing the phone.
Instead, he told the Court that he put the mobile phone back in his children's school bag after talking to police on the phone.
The trial has been adjourned for judgement next month.
